The petitioner seeks regular bail in connection with Banka (Barahat) P.S. Case No. 975 of 2016 instituted for the offences under Section 30(A) of the Bihar Prohibition and Excise Act, 2016.
The allegation is regarding recovery of 15 litres of country made liquor and 3.8 litres of illicit foreign liquor from the Auto Rickshaw being driven by the driver and some passengers are also said to have been sitting in the said Auto Rickshaw. The learned counsel for the petitioner submits that the petitioner is the owner of the said Auto Rickshaw and he had given the same to be driven by the driver for his livelihood,
Patna High Court Cr.Misc. No.63329 of 2017 (2) dt.17-01-2018 2/2 hence he has no connection with the alleged occurrence. It is submitted that the petitioner has a clean antecedent and he is in custody since 03.11.2017.
Considering the nature of accusation, the period of custody already undergone and the fact that the petitioner is having a clean antecedent, I deem it fit and proper to enlarge the petitioner above named on regular bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-II, Banka in connection with Banka (Barahat) P.S. Case No. 975 of 2016.
