For the Petitioner/s : Mr. Satyapal Singh, Advocate For the Opposite Party/s : Mr. Nawal Kishor Pd.(APP) ====================================================== CORAM: HONOURABLE THE CHIEF JUSTICE ORAL ORDER 26-03-2015 The petitioner is alleged to have committed the offences punishable under Sections 341, 323, 307, 504 and 379/34 of the Indian Penal Code, for which Murar P.S. Case No.58 of 2011 was registered against him.

Apprehending arrest, the petitioner filed A.B.P. No.612 of 2014 in the court of the Sessions Judge, Buxar. The same was dismissed on 1.8.2014. Hence, this application for grant of anticipatory bail under Section 438 of Cr.P.C. Heard learned counsel for the petitioner and learned A.P.P. for the State.

The serious offence alleged against the petitioner is referable to Section 307 I.P.C. The petitioner filed Annexure 3, which is the injury certificate issued by the Sadar Hospital, Buxar.

This Court is of the view that investigation into the allegation in the instant case does not necessitate that the petitioner must be arrested. The application is allowed. In the event of arrest, the petitioner is directed to be released on bail on furnishing the bail-bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Buxar, in connection with Murar P.S. Case No.58 of 2011, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
