Petitioner, already in custody, seeks bail in connection with Jainagar P.S. Case No.89 of 2016, registered under Sections 406, 409, 420 and 34 of the Indian Penal Code. Allegation in brief is that in the year 2006-07, Rs.5,34,000/- was withdraw by the petitioner being Incharge of the school for construction of the school building but the building remained incomplete and defalcated the government money to the tune of Rs.2,73,440/-.

Learned counsel for the petitioner submits that the allegation is against two persons, this petitioner and the Secretary, now the petitioner is ready to deposit the amount. Having considered the nature of offence, the prayer of bail

Patna High Court Cr.Misc. No.4299 of 2018(2) dt.01-02-2018 2/2 of the petitioner is rejected in connection with Jainagar P.S. Case No.89 of 2016, pending in the court of learned S.D.J.M., Madhubani.

However, the trial court is directed to expedite the trial and preferably conclude the same within a year on day to day basis.
