Heard the learned counsel for the petitioner as well as the learned Additional Public Prosecutor for the State. The petitioner apprehends his arrest in connection with Complaint Case No. 149 of 2019, registered for offence punishable under section 498A of the Indian Penal Code and section 4 of the Dowry Prohibition Act.
There is allegation of demand of dowry against the petitioner and in-laws and there is also allegation of torturing due to non-fulfillment of dowry of demand.
Patna High Court CR. MISC. No.20456 of 2020(10) dt.20-09-2022 2/3 The matter was referred to Patna High Court Mediation and Conciliation Centre for exploring the possibility of amicable solution of the dispute. The report of Mediation Centre dated 08.09.2022 is available with the record, which shows that after great persuasion, both the parties agreed to live separately and for this, the petitioner offered to pay Rs. 12,50,000/- and jewellery for final settlement to opposite party no. 2. Opposite party no. 2 accepted the offer and gave her consent for finally compromise of the case pending in the court of learned Principal Judge Family Court, Kaimur at Bhabua in Matrimonial Case No. 20 of 2018. The mode of payment of amount was agreed to be as demand draft/cheque/cash before the learned Principal Judge Family Court, Kaimur at Bhabua in Matrimonial Case No. 20 of 2018.
Considering the above-mentioned facts and circumstances, the petitioner above-named, in the event of his arrest or surrender, within four weeks from today, is directed to be released on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Sasaram, District Rohtas at Sasaram in connection with Complaint Case No. 149 of 2019, subject to condition as laid down under section 438(2) Cr. P.C.

Office shall ensure that all defects are removed by the petitioner within the stipulated time mentioned hereinabove, failing which, the matter shall be brought to the notice of this Court.
