JUSTICE ASHUTOSH KUMAR ORAL ORDER 03-06-2020 Heard Mr. Indra Mohan Kumar, learned counsel for the petitioner and learned APP for the State. The petitioners seek bail in connection with Special Case No. 1023 of 2020 arising out of Naubatpur P.S. Case No. 63 of 2020, dated 30.01.2020, instituted for the offence under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

In a raid conducted in the house of the petitioners, 40 litres of country made liquor is said to have been recovered.

Patna High Court CR. MISC. No.19237 of 2020(2) dt.03-06-2020 2/2 The petitioners claim to be innocent and said that they have been falsely implicated in this case. The petitioners are stated to be in custody since 30.01.2020.

Considering the period of custody of the petitioners, they are directed to be released on bail on their furnishing bail bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise, Patna in connection with Special Case No. 1023 of 2020 arising out of Naubatpur P.S. Case No. 63 of 2020. The application stands allowed.
