JUSTICE SANDEEP KUMAR ORAL ORDER 25-05-2023 Heard learned counsel for the petitioner and learned Additional Public Prosecutor appearing on behalf of the State. The petitioner seeks regular bail in connection with Samastipur (Muffasil) P.S. Case No. 155 of 2023, registered for the offence punishable under Sections 30(a), (b), 32, 36, 41 (I) (ii), 44(i), 62 of the Bihar Prohibition and Excise (Amendment) Act, 2018 and Sections 420, 467, 468, 471, 120(B)/34 of the Indian Penal Code.
Learned counsel for the petitioner submits that the petitioner is innocent and falsely been implicated in this case. Petitioner has no criminal antecedent. No incriminating material has been recovered from the conscious possession of the petitioner. Petitioner is in custody since

Considering the nature of allegation levelled against the petitioner, his period of custody, this application is allowed. Let the petitioner, above named, be released on bail, on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned court of Special Excise Judge-I, District- Samastipur in connection with Samastipur (Mufffasil) P.S. Case No. 155 of 2023.
