ANJANA MISHRA ORAL ORDER 3 14-10-2015 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State.

The petitioners being mother-in-law and father-in-law of the deceased apprehend their arrest in connection with a case registered for the offences punishable under Sections 304(B) and other sections of the Indian Penal Code alongwith Section 3⁄4 of the Dowry Prohibition Act.

Learned counsel for the petitioners submits that the petitioners' name did not figure at the earliest point of time in the First Information Report but subsequently, the names have been brought into the case at the instance of jealous co-villagers. It is further submitted on behalf of the petitioners that in fact, motherin-law and Devar had tried to save the girl and had taken

Patna High Court Cr.Misc. No.30096 of 2015 (3) dt.14-10-2015 P2/2 her to Sadar hospital at Lalganj and from there she was referred to Patna Medical College and Hospital, Patna. It was also submitted that father-in-law does not live in the village and he used to live outside for earning livelihood in Assam.

Considering the aforementioned fact, let the petitioners, in the event of their arrest / surrender within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the each amount to the satisfaction of the learned Chief Judicial Magistrate, Vaishali at Hajipur in connection with Vaishali P.S. Case No. 154 of 2013, subject to the conditions as laid down under Section 438(2) of the Cr. P.C.
