ANJANA MISHRA ORAL ORDER 16-10-2015 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is apprehending her arrest in connection with Tajpur P.S. Case No.384 of 2014 for allegedly having committed the offence under Sections 341, 323, 326, 326A, 307, 379 and 504/34 of the Indian Penal Code. Learned counsel for the petitioner submits that there is case and counter case between the parties. It is submitted that the informant of the present case was the tutor of the daughter of the petitioner and the petitioner is a respectable housewife. As some dispute arose for payment of tuition fee, the informant has lodged the present case.

Considering the fact that there is case and counter

Patna High Court Cr.Misc. No.30144 of 2015 (3) dt.16-10-2015 2/2 case between the parties and that the petitioner has no criminal antecedents, let the petitioner, above named, in the event of her arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Shri Nitin Kaushik, learned Judicial Magistrate,1st Class, Samastipur, in connection with Tajpur P.S. Case No.384 of 2014, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
