JUSTICE MADHURESH PRASAD ORAL ORDER 10-01-2018 Heard learned counsel for the petitioner and learned APP for the State.

Petitioner is an accused in a case registered for offence under sections 272, 273 and 34 of the IPC and sections 30(a), 38, 41 and 48 of the Bihar Prohibition and Excise Act, 2016 for recovery of 70 and odd bottles of foreign liquor from a vehicle. Counsel for the petitioner submits that he is neither the owner of the vehicle nor he is any way connected with the liquor. Prior to the lodging of this case, he is not accused in other case. Petitioner is in jail custody since 15.11.2017. In the facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named be released on bail on his furnishing bonds of Rs 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Addl. Sessions Judge cum special judge, Excise Act, Muzaffarpur in Siwaipatti Police Station Case No. 132 of 2017 on the following conditions :- (a) That one of the bailors will be a close relative of the Petitioner who will give an affidavit giving genealogy as to how he is related with the Petitioner.
