JUSTICE MOHIT KUMAR SHAH ORAL ORDER 27-07-2023 The present writ petition has been filed seeking the following reliefs:- "1(i). For quashing of the resolution dated 01.07.11 contained in memo no. 1403 dated 01.07.11 whereby the petitioner has been awarded punishment of withholding of two annual increments with cumulative effect despite the fact that petitioner was not found

Patna High Court CWJC No.18244 of 2014(2) dt.27-07-2023 2/3 guilty of charges levelled against him by the enquiry officer during departmental enquiry.

(ii). Further for a direction upon the respondents to make payment of entire consequential benefits including promotional benefits, arrears of salary and pensionary benefits which has been kept pending in want of final conclusion of departmental proceeding taking into consideration that the petitioner retired from service.

(iii). For a direction upon the respondents to finally decide the appeal filed by the petitioner before the then Chairman of the erstwhile Bihar State Electricity Board, Patna on 07.12.2011 which is still pending before the competent authority for final consideration and disposal. 2.

At the outset, the learned counsel for the petitioner seeks a direction upon the appellate authority to dispose off the appeal, filed by the petitioner on 7.12.2011. 3.

Having regard to the limited prayer made by the learned counsel for the petitioner, I deem it fit and proper to direct the appellate authority to dispose off the appeal of the petitioner in case the same is still pending, after providing an opportunity of hearing to the petitioner, by passing a reasoned and a speaking order, in accordance with law, within a period of four weeks of receipt / production of a copy of this order.
