JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 26-03-2018 Heard learned counsel for the petitioner and the State. In view of the fact that the State Appellate Authority is now functional to hear the appeal against the decision of the District Teachers Employment Appellate Authority, learned counsel for the petitioner seeks permission to withdraw this writ petition in order to enable the petitioner to approach the State Appellate Authority for redressal of his grievance by way of filing appeal.
Permission is granted.
In the event the petitioner files appeal within a period of
Patna High Court CWJC No.3612 of 2016(3) dt.26-03-2018 2/2 one month from today, the State Appellate Authority is required to decide the appeal on its own merit in accordance with law after condoning the delay, if any, in filing the appeal in view of the fact that the present writ petition remained pending for more than two years.
With the aforesaid liberty, the writ petition stands disposed of.
