The petitioner is languishing in custody for the offences punishable under Sections 341/323/325/307/379/34 of the Indian Penal Code.

The petitioner was allowed regular bail by order dated 23.04.2018 passed in Cr. Misc. No.22593 of 2018 in connection with Banmankhi P.S. Case No.9 of 2018 with rider that if the petitioner would be found suppressing the criminal antecedent in the sense the referred case is still pending then the Court-below would be at liberty to cancel the bail bond of the petitioner for suppression of material. A criminal case

Patna High Court CR. MISC. No.19860 of 2019(2) dt.24-04-2019 2/2 instituted in the year 2004 is still pending against the petitioner and considering the aforesaid fact the Court-below cancelled the bail bond of the petitioner and thereafter the petitioner is in custody after surrender since 18.02.2019.

Considering the fact that for suppression of fact the petitioner has sufficiently been punished, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with S.T. No.5 of 2019, arising out of Banmankhi P.S. Case No.9 of 2018, with condition that petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
