JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 03-06-2020 Heard learned counsel for the petitioner and the learned A.P.P. for the State through video conferencing. The petitioner seeks bail in connection with Jamhore P.S. Case No. 127 of 2019, registered under Sections 341, 323, 504, 324 and 307/34 of the Indian Penal Code. The accusation is that on 11.12.2019 at about 3.00 P.M., when informant Tejnarayan Singh was cleaning his filed, at that time, petitioner along with Lallu Kumar and his wife Gayatri Devi and two unknown came there and started to abuse. When informant made protest, then all caused assault through lathi and stick and tried to push his neck by folding Gamchha, when Amrawati Devi and Ansika Kumari, wife and daughter of informant, rushed to save then they were also assaulted. Learned counsel for the petitioner submits that while allegation has been made against petitioner and others to caused injury to the informant, but only one injury was found on the person of informant. Further submission is that petitioner has no criminal antecedent and he is in custody since 27.12.2019.

On the other hand, learned A.P.P. appearing for the State opposed the prayer for bail of the petitioner with submission that three injuries were found on the person of informant, out of which injury No.1 is grievous in nature, which was on forearm.

Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Addl. Chief Judicial Magistrate-III, Aurangabad in connection with Jamhore P.S. Case No. 127 of 2019.
