The petitioner is accused in Barhiya Police Station Case No 135 of 2017 dated 01.07.2017 registered for the offences punishable under Sections 25/26/35 of Arms Act. Counsel for the petitioner submits that the first information report has been lodged by the Sub Inspector alleging that while he had proceeded to make arrest of certain accused persons, the petitioner was apprehended from a hut from where one loaded country made pistol has also been seized. It is further submitted that even as per the allegation, the recovery is not attributed from the possession of the petitioner. Petitioner is in custody since 02.07.2017 and investigation in the case is complete.
Patna High Court Cr.Misc. No.55117 of 2017 (2) dt.12-12-2017 2/2 Considering the aforesaid submission, prayer for bail is allowed. Let the petitioner above named be released on bail on his furnishing bonds of Rs 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Lakhisarai in Barhiya Police Station Case No 135 of 2017 subject to the following conditions : (i) That one of the bailors will be a close relative of the petitioner who will give an affidavit giving genealogy as to how he is related with the petitioner. The bailor will also undertake to inform the Court if there is any change in the address of the petitioner.
(ii) That the petitioner will be well represented on each date and if he fails to do so on two consecutive dates, his bail will be liable to be cancelled.
