The petitioner seeks bail in Spl. Case No. 176 of 2020, arising out of Barh P.S. Case No. 471 of 2020, registered for the offence under Section 414 of the Indian Penal Code, Section 20/22 of the NDPS Act and Sections 26/35 of the Arms Act.

As per the prosecution case, 3 kg. Ganja was recovered from the basement of market of co-accused Rajnish Kumar and one country-made pistol alongwith two live cartridge has been recovered from the possession of co-accused Nitish Kumar @ Bajrangi. Petitioner is alleged to be business partner of co-accused Rajnish Kumar.

It is submitted on behalf of petitioner that no incriminating article has been recovered from the conscious

Patna High Court CR. MISC. No.39921 of 2021(2) dt.14-12-2021 2/2 possession of the petitioner. Petitioner has got clean antecedent and he is in custody since 26.12.2020.

Learned A.P.P. for the State has opposed the bail petition.

Considering the aforesaid facts and circumstances, the bail petition of petitioner is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge XIII cum Special Judge, NDPS Act, Patna in connection with Spl. Case No. 176 of 2020, arising out of Barh P.S. Case No. 471 of 2020.
