Petitioner is in jail custody since 10.1.2020 in connection with Narpatganj (Bathnaha) P.S. Case No. 69 of 2019 registered for the offences punishable under Sections 302/34 of the Indian Penal Code.

Petitioner is said to have made attempt to gave Lathi blow to informant's wife but, unfortunately, the aforesaid blow hit to minor daughter of informant.

Petitioner is full brother of informant and the alleged occurrence is said to have taken place on 31.1.2019 but the farde-beyan of the informant was recorded on 2.2.2019. Moreover, in postmortem report, no external or internal injury was found on the person of the deceased and the doctor could not give

Patna High Court CR. MISC. No.20110 of 2020(4) dt.12-10-2020 2/2 exact cause of death of the deceased. The investigation of this case has already been completed.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Araria in connection with Narpatganj (Bathnaha) P.S. Case No. 69 of 2019.
