JUSTICE DINESH KUMAR SINGH ORAL ORDER 19-08-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 341,323 and 504/34 of the Indian Penal Code and section 3(1)(x) of the Scheduled Caste and Scheduled Tribe (Prevention of Atrocities) Act. The accusation is of assaulting the informant and abusing by calling caste name.

It is submitted by the learned counsel for the petitioner that for the occurrence of 19.11.2014 the FIR was registered on 17.1.2015 and Title Suit No. 108 of 2000 was filed by the informant against the petitioner and others. Considering the delayed lodging of the case and the title suit being pending from before, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Bhojpur at Ara in connection with Bhojpur SC/ST P.S. Case No.1 of 2015 subject to the conditions as laid down under Section 438(2) Cr.P.C.
