JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 17-04-2018 Heard learned counsel for the petitioner, learned counsel appearing on behalf of the respondent and the State. Learned counsel for the petitioner placed reliance on decision of this Court in C.W.J.C. No. 1867 of 2016 dated 20.03.2018, where this Court on consideration of submission of the parties held out that denial of principles of natural justice itself is a prejudice. No further prejudice is required to establish. Learned counsel appearing on behalf of the respondent submits that in C.W.J.C. No. 1867 of 2016, the present petitioner appeared through counsel and argued on

Patna High Court CWJC No.9624 of 2016(2) dt.17-04-2018 2/2 behalf of the private respondent. In the said case this Court hearing the parties remitted the care to the District Programme Officer, Katihar to hear the parties and after opportunity of hearing to the parties including the petitioner and Mr. Jamil Akhtar, the District Programme Officer, Katihar directed to pass fresh order in accordance with law.

Considering the aforesaid fact writ petition is also disposed on similar cone as the present case also arises out of the same transaction.
