The present writ petition has been filed by the petitioner for quashing of letter No.3369 dated 17.11.2023 issued by respondent No.5 by which the petitioner was informed that he has completed 42 years of service due to which he has been superannuated with effect from 31.01.2023. Further prayer is to direct the concerned respondents to pay the deducted salary

Patna High Court CWJC No.5119 of 2025(2) dt.03-04-2025 2/2 of the petitioner from February, 2023 to 17.11.2023 from the retiral benefits and pension.

3. Learned Counsel for the petitioners submits that vide Annexure-P/3 the petitioner has filed representation but no decision has been taken by the Municipal Commission, Nagar Nigam, Chapra.

4. Learned Counsel for the Municipal Corporation submits that this case may be disposed off so that the decision could be taken by the Municipal Commission, Nagar Nigam, Chapra, on the representation of the petitioner.

5. In the light of the submissions made, this writ petition is disposed off directing respondent No.5, the Municipal Commissioner, Nagar Nigam, Chapra, to take a decision in accordance with law on the representation filed by the petitioner (Annexure-P/3) within 90 days from the date of receipt/production of a copy of this order.
