The petitioner is in custody in connection with Bettiah Muffasil P.S. Case No. 728 of 2020 for the offence under Sections 302, 201, 34 of the Indian Penal Code. Learned counsel for the petitioner submits that the petitioner has got no criminal antecedent and he is in custody since 09.01.2023.

As per F.I.R., on 19.11.2020 the son of informant, namely, Upendra Kumar left his house for teaching but he did not return then the informant tried to contact his son. Thereafter, the dead body of his son was found lying at Akraha pool and the informant expressed his suspicion towards Kishori Jaiswal and others in killing of his son, as they threatened the informant's son to kill him whenever he demanded tuition fee.
