ANJANA PRAKASH ORAL JUDGMENT Date: 06-07-2015 Heard learned counsel for the Petitioner and the State. The Petitioner seeks quashing of the order of cognizance dated 17.2.2014 passed by the Chief Judicial Magistrate, Lakhisari, in Chanan P.S. Case No. 23 of 2013 on the ground that the subject matter of the present case is the offshoot of Chanan P.S. Case No. 22 of 2013.
It has been submitted that initially, under the Provisions of Arms Act, Chanan P.S. Case No. 22 of 2013 was registered wherein it was learnt that the Arms were in the house of the Petitioner. The said case was investigated and Arms were recovered after which separate case i.e. Chanan P.S. Case No. 23 of 2013 was instituted, even though, both the cases were inter connected.
Patna High Court Cr.Misc. No.29924 of 2015 dt.06-07-2015 2/2 Considering the facts as aforesaid, the Court below is directed to amalgamate present case with Chanan P.S. Case No. 23 of 2013 in order to avoid multiplicity of Proceeding. With the aforesaid observation, the application stands disposed off.
