The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 147, 148, 149, 448, 307, 120B , 354 and 506 of the Indian Penal Code and Sections 25 (1-B) a, 26, 27 and 35 of the Arms Act. It is alleged that the accused persons including the petitioner came armed with deadly weapons and on the order of co-accused Md. Billa, co-accused Md. Chhotu opened fire but no injury was caused to any one. It is further alleged that on information, police came and on search being made, one loaded pistol was recovered from possession of co-accused Fucho Mian. It is submitted by learned counsel for the petitioner that neither any overt act nor any recovery has been alleged against this petitioner. The petitioner has no criminal antecedent.

No.31439 of 2015 (2) dt.03-08-2015 2/2 Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail in the event of his arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Bhagalpur in connection with Mojahidpur P.S. Case No. 86 of 2015, subject to the conditions as laid down under Section 438(2) Cr.P.C.
