The petitioner seeks regular bail in connection with Rupauli P.S. Case No.83 of 2015 registered for the offences punishable under Sections 366, 120-B/34 and 363 of the Indian Penal Code.
The allegation as per F.I.R. is that this petitioner and three others abducted the wife of the informant with intention to perform her marriage. It has been submitted that the informant is residing in Punjab in connection with his livelihood. His wife was leading deserted life so she was working at the house of brother of the petitioner. It has further been submitted that the victim and her husband have compromised the case with the accused persons
Patna High Court Cr.Misc. No.63221 of 2017 (2) dt.12-01-2018 and the wife of informant has not stated any misbehave at the instance of this petitioner in her statement given before Magistrate under Section 164 of Cr.P.C. The petitioner is in custody since 31.08.2017 having clean antecedent. The learned A.P.P. for the State opposed the submission.
Considering the facts and circumstances of the case, the prayer of bail is allowed. The petitioner, named above, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of like amount each to the satisfaction of the learned A.C.J.M. 1st, Purnea in connection with Rupauli P.S. Case No.83 of 2015 (G.R. No.1588 of 2015).
