The present writ petition has been filed seeking a direction to the respondents to make payment of arrears related to the revision of salaries, dearness allowance, the difference in pay under the 1st A.C.P., the difference in benefits under the 2nd A.C.P., and other amounts, which, according to the petitioner, total 2,77,86/-.

3. Learned counsel for the petitioner submits that the

Patna High Court CWJC No.5518 of 2025(2) dt.07-04-2025 2/3 petitioner joined his service as Safai Mazdoor/Sweeper on 14.05.1992, following his appointment by the competent authority, i.e., the Executive Officer, Bankipur Circle, Patna Municipal Corporation, Patna. He was posted at the Patna Municipal Corporation under Bankipur Anchal, in Ward No. 41. Learned counsel further submits that since the date of his appointment, the petitioner has been working with the full satisfaction of the respondents until the date of his retirement. He further submits that during his service period, the petitioner's pay scale was enhanced, and he was granted the benefits of the 1st and 2nd A.C.P. after completing the required period of service. Moreover, between the 6th and 7th Pay Revision Commissions, the petitioner's pay scale was revised; however, these benefits were not extended to him during his service. Learned counsel further submits that the petitioner superannuated on 31.12.2024, but to date, the payment has not been made to him.

Learned counsel further submits that the petitioner submitted a representation on 21.09.2024 before the Executive Officer, Bankipur Anchal, Patna Municipal Corporation, Patna (annexed as Annexure P/2 to the writ petition), seeking redressal of his grievances regarding the payment of the aforementioned

Patna High Court CWJC No.5518 of 2025(2) dt.07-04-2025 3/3 dues. However, despite this, no payment has been made as yet, and the representation is annexed as Annexure P/2.

5. Learned counsel for the Patna Municipal Corporation submits that a direction may be issued to the petitioner to file a fresh representation for the redressal of his grievances.

In the aforesaid background, the petitioner is directed to file a fresh representation before respondent No. 3, namely, the Executive Officer, Bankipur Circle, Patna Municipal Corporation, Patna, along with a copy of this order, within 30 days from today. Upon receipt of the representation, the Executive Officer, Bankipur Circle, Patna Municipal Corporation, Patna, is directed to take a decision on the said representation within 90 days from the date of its filing, with a reasoned and speaking order.

7. With the aforesaid observation and direction, the writ petition stands disposed off.
