JUSTICE MOHIT KUMAR SHAH ORAL ORDER 17-01-2018 Heard the learned counsel for the petitioners and the learned A.P.P. for the State.

The petitioners seek regular bail in connection with Karaghar (Sidhi) P.S. Case No. 334 of 2017 instituted for the offences under Section 30(A) of the Bihar Prohibition and Excise Amendment Act, 2016.

The allegation is regarding recovery of two liters of illicit country made liquor from the motorcycle of the petitioners. The learned counsel for the petitioners submits that the petitioners have been falsely implicated in the present case and they have a clean antecedent. It is submitted that the petitioners are in custody since 26.11.2017.

Considering the nature of accusation, the period of

No.63323 of 2017 (2) dt.17-01-2018 2/2 custody already undergone and the fact that the petitioner is having a clean antecedent, I deem it fit and proper to enlarge the petitioners above named on regular bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) each with two sureties of the like amount each to the satisfaction of learned Additional District and Sessions Judge-II-cum-Special Court (Judge), Excise, Rohtas at Sasaram in connection with Karaghar (Sidhi) P.S. Case No. 334 of 2017.
