The petitioners No.2 Jitendra Yadav @ Jitendra Kumar and 3. Harendra Yadav @ Harendra Kumar apprehend their arrest in a case under Section 307 and some other sections of the Indian Penal Code.
Gopal Singh Yadav, the informant, named the petitioners and other accused persons and alleged that petitioner No.2 assaulted on his head with Garansa but the informant has not made any specific allegation against petitioner No.3. It is submitted that there is counter version and on account of land dispute the occurrence took place. Gopal Singh
Patna High Court Cr.Misc. No.33482 of 2015 (3) dt.15-10-2015 2/2 Yadav got simple injury on his head as would appear from annexure3 at pages 18 and 19.
Considering the facts aforesaid, the Petitioner No.2 Jitendra Yadav @ Jitendra Kumar and petitioner No.3 Harendra Yadav @ Harendra Kumar, in the event of their arrest or surrender before the learned court below within a period of four weeks from the date of receipt / production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Aurangabad in Rafiganj P.S. Case No. 48 of 2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
