Petitioner seeks bail in Govindpur P.S. Case No.26 of 2009 instituted for the offence under Section(s) 448, 323, 307, 354 Indian Penal Code.

It is a case of misuse of privilege of bail.

From the impugned order, it appears that bail bond of the petitioner was cancelled on 16.04.2013. He was declared absconder on 25.01.2018. Thereafter, he voluntarily surrendered on 06.07.2018 and since then he is in custody. This Court finds that petitioner has sufficiently been punished for the laches.

Let the petitioner, above named, be released on bail

Patna High Court Cr.Misc. No.51108 of 2018 (2) dt.25-09-2018 2/2 on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the Additional Sessions Judge, V, Nawada, in connection with Govindpur P.S. Case No.26 of 2009, subject to the condition that both the bailors shall be close relative of the petitioner. Petitioner will remain present on each and every date of trial and his absence on two consecutive date(s) without any reasonable cause will make his bail bond liable to be cancelled.
