The petitioners seek bail in a case registered under Sections-302, 201/34 of the Indian Penal Code. The prosecution case, in brief, is that a dead body was found near pillar No. 29 of Ganga Bridge.

It has been submitted on behalf of the petitioners that the petitioners are in custody since 21-06-2018 and they have got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioners. Charge sheet has already been submitted in this case. It is a case of last seen. There is no eye witness to the alleged occurrence nor there is any circumstantial evidence to suggest the involvement of the

Patna High Court Cr.Misc. No.50999 of 2018 (2) dt.18-09-2018 petitioners in the present case. Due to previous enmity, the petitioners have been made accused in the present case. On behalf of the State, it is submitted that the petitioners are named in the Complaint Case/F.I.R.

Considering the aforesaid facts and circumstances, let the petitioners, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Rail, Khagaria in connection with Khagaria Rail P.S. Case No. 23 of 2018.
