The petitioner seeks bail in a case registered for offences under Sections 341, 324, 307, 504 and 290 of the Indian Penal Code and Section 37(C) of the Bihar Prohibition and Excise Act, 2016.
The allegation against the petitioner is that he has tried to assault his brother namely Shatrughan Kumar in a drunken state, however, it is contended that there is simple injury to him. It is urged that the petitioner has remained in custody since 02.07.2017, i.e., for about more than four and
Patna High Court Cr.Misc. No.56302 of 2017(2) dt.23-11-2017 2/2 half months. It is claimed that the petitioner is having clean antecedent.
Considering the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on his furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Special Judge, Excise Act, Muzaffarpur in connection with Town P.S. Case No. 444 oof 2017 with a condition that if the petitioner, after his release in this case, is again found to be involved in criminal case of similar nature, the court concerned would be at liberty to take steps for cancellation of his bail bonds. However, at the time of acceptance of bail bonds the petitioner's antecedent would be verified by the court below and if he is found to be involved in any criminal cases before the date of filing of the present application, i.e., on 18.11.2017 then he would not be released on bail.
