Mrs.Asha Kumari ====================================================== CORAM: HONOURABLE MR. JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 04-04-2019 Heard learned counsel for the petitioner and State. The petitioner is in custody in connection with Ujiyarpur P.S. Case No. 01 of 2019 for the offence under Sections 272, 273 of the Indian Penal Code and Sections 30(a) and 36 of the Bihar Prohibition Excise Amendment Act. Learned counsel for the petitioner submits that the petitioner has got no criminal antecedent and he is in custody since 01.01.2019. He further submits that in the instant case total 236.52 litres of foreign liquor was seized from a Mahindra Pic-Up Van. He also submits that petitioner has no concerned with the seized liquor. He further submits that the petitioner is only the driver of the said vehicle.

Considering the fact that the petitioner has got no criminal antecedent and he is only the driver of the vehicle from which the liquor was recovered, the petitioner, named above, is
