JUSTICE SATYAVRAT VERMA ORAL ORDER 30-09-2022 Heard learned counsel for the petitioner and learned A.P.P. for the State through virtual Court proceedings. The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 147, 148, 149, 307, 323, 324, 504 and 506 of the Indian Penal Code and Section 27 of the Arms Act.

The informant alleges that the accused persons, including the petitioner, came to her house and the named accused persons assaulted her family members and petitioner who was carrying gun fired, but no one was injured. Learned counsel for the petitioner submits that the petitioner has antecedent of one case and he has been falsely implicated in the present case with an ornamental allegation of firing, it is further submitted that no specific overt act of assault

Patna High Court CR. MISC. No.19383 of 2022(2) dt.30-09-2022 2/2 is alleged against the petitioner.

Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.

Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, in the event of his arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Shahkund (Sajour) P.S. Case No. 213 of 2021 subject to the conditions as laid down under Section 438 (2) of the Cr.P.C. with a further condition that one of the bailors of the petitioner shall be his maternal uncle, Mahesh Yadav.
