JUSTICE ARUN KUMAR ORAL ORDER 10-01-2018 Heard learned counsels for the petitioner and the State. The petitioner, already in custody, seeks bail in connection with Buxar (Muffasil) P.S.Case No. 251 of 2017 registered under Sections 399, 402 and 414 of the Indian penal Code and Section 25(1-B)A/26/35 of the Arms Act.

Allegation in brief is that police, during evening patrolling, suspected some persons assembled at a particular place and one country made revolver with one live cartridge were recovered from the possession of the petitioner along with one stolen motorcycle.

Learned counsel for the petitioner submits that petitioner has enmity with Ram Lakhan Paswan and he is instrumental in getting him falsely implicated in this case, petitioner is a student of Intermediate and has qualified for selection in Bihar Police and

Patna High Court Cr.Misc. No.62370 of 2017 (2) dt.10-01-2018 2/2 he is in custody since 13.10.2017 having no criminal antecedent. Having considered the aforesaid facts and circumstances, the petitioner, namely, Pradeep Kumar @ Pradeep Yadav is directed to be released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate in connection with Buxar (Muffasil) P.S. Case No. 251 of 2017 with condition that one of the bailor must be his father. Petitioner shall remain physically present on each and every date during trial and in case of failure on two consecutive dates without any medical urgency, his bail bond shall liable to be cancelled.
