13-07-2020 Heard learned counsel for the petitioner as well as learned A.P.P. for the State through video conferencing. The petitioner apprehends his arrest in Sitamarhi P.S. Case No. 538 of 2019 registered for the offence under Sections 363, 366(A) r/w Section 34 of the Indian Penal Code. It is submitted on behalf of petitioner that petitioner is innocent and has committed no offence. It is further submitted that the victim, in her statement recorded under Section 164 Cr.P.C., has stated that she had voluntarily gone with petitioner and solemnized marriage four months ago and she wants to live with petitioner (Annexure - 2). The age of the victim has been assessed to be 18 years. Petitioner has no criminal antecedent. Considering the aforesaid facts and circumstances, the
