The petitioner apprehends his arrest in Sadar P.S. Case No. 350 of 2013, registered for the offences punishable under Sections 420 and 307 of the Indian Penal Code. The wife of the petitioner filed this complaint case on the basis of which the present FIR was lodged alleging therein that the petitioner had taken loan of Rs. 8,00,000/- from the informant and gave a cheque of Bank of Baroda bearing No. 514980, but the same was dishonoured.

It has been submitted that all the allegations are false and concocted. The informant is the wife of the petitioner. Prior to lodging of this case the informant lodged Purnea Sadar Mahila P.S. Case No. 26 of 2013 under Section 498A and other Sections

Patna High Court Cr.Misc. No.35014 of 2014 (3) dt.13-03-2015 2/2 of the Indian Penal Code on 04.06.2013. The complainant was not residing with the petitioner. At the time of filing of this case the complainant had taken cheque from the house of the petitioner and she filed this false case.

Considering the facts aforesaid the petitioner, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Purnea in connection with Sadar P.S. Case No. 350 of 2013, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
