This is a petition for grant of regular bail for the offences under Sections 302, 34 of the Indian Penal Code. The petitioner is the husband of the deceased. There is allegation of commission of murder against the petitioner and his family members. The allegation is based on suspicion. There is no eye-witness of the occurrence nor there is definite opinion of the doctor that the case is of homicidal death.
Hence, there is no reason to detain the petitioner as under trial prisoner.
Considering the aforesaid facts, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.
Patna High Court Cr.Misc. No.62923 of 2017 (3) dt.19-02-2018 2/2 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate 1st Class, Patna City in connection with Malsalami P.S. Case No. 207/2016. (Birendra Kumar, J.) Rakhi U T
