1. The present writ petition has been filed seeking the following relief(s):- "1.(i) For quashing the order as contained in Memo No. 5101 dated 07.11.2023 issued under the signature of respondent No. 3 whereby and where under the basic honorarium of the petitioner has been reduced by 5% for two years in light of paragraph No. 1 (iv) of Departmental Letter No. 196 dated 25.03.2022.

(ii) Also for quashing the letter as contained in Memo No. 361 dated 05.02.2024 issued under the signature of Deputy Development Commissioner, Muzaffarpur by which the petitioner has been directed to deposit the punishment amount.

(iii) Also for directing the respondents to stop to reduce by 5% from the basic honorarium of the petitioner."

At the outset, the learned counsel for the petitioner submits by referring to paragraph no.14, of the present writ petition that the petitioner has filed an appeal bearing Appeal No.27 of 2023, before the District Magistrate, Muzaffarpur, however, the same is still pending, hence appropriate directions be issued for disposal of the same and during the interregnum period some protection be granted.

3. The learned counsel for the respondent-State submits that in case the aforesaid appeal is still pending consideration, the same would definitely be disposed off within a stipulated time frame.

4. Having regard to the facts and circumstances of the case, I deem it fit and proper to direct the District Magistrate, Muzaffarpur, to dispose off the aforesaid appeal, in case the same has not yet been disposed off, by passing a reasoned and a speaking order, in accordance with law, within a period of six weeks of receipt/production of a copy of this order and till then no recovery shall be made from the petitioner.

5. The writ petition stands disposed off on the aforesaid terms.
