JUSTICE DINESH KUMAR SINGH ORAL ORDER 18-03-2015 Heard learned counsels for the petitioner, complainant and the State.
The petitioner being husband of the complainant is apprehending arrest in a complaint case in which process has been directed to be issued after cognizance being taken for the offences punishable under Section 498A of the Indian Penal Code and sections 3 and 4 of the Dowry Prohibition Act. The basic accusation is of torture for non fulfillment of dowry demands.
As jointly prayed for, the matter was referred to Mediation Centre. The Mediator's report at Flag X reflects that the petitioner and the complainant have reconciled the issue and
Patna High Court Cr.Misc. No.29385 of 2014 (6) dt.18-03-2015 2/2 agreed to live together as husband and wife and they are no longer interested to contest the cases filed against each other. Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Vaishali at Hajipur in connection with Complaint Case No. 2939 of 2013 subject to the conditions as laid down under Section 438(2) Cr.P.C.
