JUSTICE SUDHIR SINGH ORAL ORDER 02-07-2019 Heard learned counsel for the petitioner, learned APP for the State and learned counsel for the opposite party No.2. The petitioner was granted provisional bail by order dated 3.4.2019 and the matter was referred to the Mediation Centre. As per the report of the Mediator, mediation has failed. It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner has falsely been implicated in the present case due to petty family dispute. The case is triable by the Magistrate.

Considering the aforesaid facts and circumstances, the provisional bail granted to the petitioner by order dated 3.4.2019 is hereby confirmed in connection with Complaint case No.3870 of 2015 (Tr. No.1955 of 2018) pending in the court of Sub Divisional Judicial Magistrate, Vaishali at Hajipur. If so advised, either of the parties will be at liberty to make an application before the Court below for referring the matter to the District Mediation Centre for the purpose of reconciliation or one time settlement.
