Heard learned counsel for the petitioner and learned A.P.P. for the State.
The petitioner seeks regular bail in connection with Chanpaitya (Kumarbagh OP) P.S. Case No. 617 of 2021 lodged under Sections 366A, 372/34 of IPC read with Section 12 of POCSO Act.
As per the prosecution case, after direction made by this Court vide order dated 25.08.2022, the alleged victim girl has been recovered and her statement under Section 164 has been recorded in which she has narrated the entire story by which it transpire that there is no involvement of the present
Patna High Court CR. MISC. No.19363 of 2022(4) dt.12-09-2022 2/2 petitioner in this matter.
Learned counsel for the informant vehemently opposes the prayer for bail and submits that the alleged victim girl is minor.
In the present facts and circumstances of this case and the submissions made above, let the petitioner above named, be granted bail on furnishing bail bonds of Rs.30,000/- (Rupees Thirty thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge POCSO-cumAdditional District Judge-VI, Bettiah, West Champaran in connection with Chanpatiya (Kumarbagh OP) P.S. Case No. 617 of 2021, subject to the conditions as laid down under Section 437(3) of Cr.P.C.
With this observation, the bail application stands allowed.
