JUSTICE SUDHIR SINGH ORAL ORDER 08-01-2018 Heard learned counsel for the petitioners, learned counsel for the State and learned counsel for the informant. The petitioners seek bail in a case instituted under Sections 498(A), 326, 307, 341, 323, 504, 120(B) of the Indian Penal Code and later on Section 304(B) of the Indian Penal Code and 3⁄4 of D.P. Act were added.
The allegation against the petitioners is of committing murder of the deceased due to non-fulfillment of the demand of dowry.
It has been submitted on behalf of the petitioners that the petitioner no.1 is in custody since 25.09.2017, petitioner no.2 is in custody since 07.09.2017, petitioner no.3 is in custody since
Patna High Court Cr.Misc. No.62568 of 2017 (2) dt.08-01-2018 2/2 30.10.2017 and petitioner no.4 is in custody since 12.11.2017 respectively. The petitioners have got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioners. The petitioners have falsely been implicated in the present case. The petitioners are in-laws of the deceased. They are separate in mess and property from the husband of the deceased. The husband of the deceased is in custody.
On behalf of the state and counsel for the informant, it has been submitted that the petitioners are named in the F.I.R. Considering the aforesaid facts and circumstances, let the petitioners above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned C.J.M., Saharsa, in connection with Saharsa Sadar P.S. case No.582 of 2017.
