JUSTICE ARUN KUMAR ORAL ORDER 20-12-2017 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody, seeks bail in Kako PS Case No. 188 of 2017 registered under Sections 379, 411, 413 and 414 of the IPC.

The allegation in brief is that on disclosure made by another co-accused about sale of the stolen motorcycle to the petitioner, thereafter the said motorcycle was recovered from the petitioner. Learned Counsel for the petitioner submits that Santosh Kumar, similarly situated another co-accused who was apprehended with the stolen motorcycle by the police on the spot was granted bail by a coordinate Bench of this Court and there is no allegation of committing theft by this petitioner and the petitioner has no criminal antecedent. The police has submitted charge sheet. Having considered the said facts and circumstances, the petitioner, namely Manish Kumar is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sri Rajesh Kumar Rajak,Sub-Judge-4, Jehanabad in connection with Kako PS Case No. 188 of 2017.
