JUSTICE DINESH KUMAR SINGH ORAL ORDER 07-12-2015 Petitioner being husband of the complainant is apprehending his arrest in a complaint case wherein processes were directed to be issued after cognizance being taken for the offences punishable under Sections 498A, 494 of the Indian Penal Code and Section 3⁄4 of the Dowry Prohibition Act.

The basic accusation is of torture for nonfulfilment of dowry demand and performing second marriage. It appears that in spite of valid service of notice, none is appearing on behalf of the informant/O.P. No. 2. It is submitted by learned counsel for the petitioner that both sides have decided to part ways and a joint application to that effect has been filed before learned Court below. The certified copy of the same has been brought on record. Let it be kept on record.

No.31564 of 2015 (4) dt.07-12-2015 2/2 Considering the aforesaid facts, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of 12 weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Samastipur in connection with Pusa P.S. Case No. 92 of 2014, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
