JUSTICE ARUN KUMAR ORAL ORDER 18-01-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody, seeks bail in Alamganj PS Case No. 238 of 2017 registered under Sections 399, 402 of the IPC Sections 25(1-b)a, 26, 35 of the Arms Act and Sections 20/22 of the NDPS Act.

The allegation in brief is that the police apprehended few people, alleged to have assembled for making plan for committing dacoity, and recovered loaded pistol with five cartridges and 500 grams of Ganja from possession of the petitioner. From others also there is recovery, Submission is that is thee is recovery of a very small quantity of Ganja, one pistol and five cartridges, however the petitioner is in custody since 21.6.2017.

Having considered the said facts and circumstances, the petitioner, namely, Aakash Kumar @ Bikatiya is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge X, Patna in connection with Alamganj PS Case No. 238 of 2017.
