Petitioner seeks bail in Ghosi (Okari) P.S. Case No.128 of 2018 instituted for the offence under Section(s) 379 Indian Penal Code.
Counsel for the petitioner submits that there is no recovery from the possession of the petitioner. He is not named in the First Information Report. It is also submitted that during investigation it transpired that said wire was stolen away by the pickup van of Vidya Travels, but registration number of vehicle could not be traced out.
The petitioner was arrested on 21.05.2018 merely on suspicion because he was driver of one of the pickup van of
Patna High Court Cr.Misc. No.51170 of 2018 (2) dt.25-09-2018 2/2 Vidya Travels. Thereafter, confessional statement of the petitioner was recorded.
In the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Sub-Judge, 1st, Jehanabad, in connection with Ghosi (Okari) P.S. Case No.128 of 2018, subject to the condition that both the bailors shall be close relative of the petitioner. (Sanjay Priya, J) JA/- U T
