The petitioners apprehend arrest in connection with Sabour (Goradih) P.S. Case No. 143 of 2020 registered under Sections 341, 323, 384, 467, 468, 471, 504, 506 and 120B of the Indian Penal Code.

Learned counsel appearing on behalf of the petitioners submits that petitioners are innocent and have falsely been implicated in the present case due to village politics. Prior to the present case, petitioner no.1 had given a written complaint (Annexure-2 series) against the informant and Junior Engineer before the District Magistrate, Bhagalpur regarding the scam in Manrega Yojana. Further he submits that petitioner no. 1 had

No.39922 of 2021(3) dt.11-03-2022 2/2 also filed a petition (Annexure-3) before the Court below regarding scam in the said Yojana, due to which the petitioners have falsely been implicated in the instant case. It is also submitted that one more application has been given against the Mukhiya and others before the Deputy Inspector General of Police regarding cutting of trees without permission of the competent authority, as contained in Annexure-4. Thereafter, Anchal Adhikari instituted a case (Annexure-5) against the Mukhiya and others. Further he submits that the present case has been lodged against the petitioners only to save their skin from scam.

Having considered the facts and circumstances of the case, let the above named petitioners be released on bail, in the event of arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of C.J.M., Bhagalpur in connection with Sabour (Goradih) P.S. Case No. 143 of 2020, subject to the condition as laid down under Section 438(2) of the Cr. P.C.
