The petitioner apprehends arrest in a case registered for the offence punishable under sections 307/354B/379/34 and other allied sections of the Indian Penal Code. Allegation against this petitioner is of commission of assault with iron rod.
Learned counsel appearing for the petitioner submits that the parties are co-villagers and co-sharer and they have land dispute also. He submits that though there is allegation of assault with iron rod to the informant, but the doctor has found simple injuries. There is delay of 5 days in lodging of the FIR and there is no explanation of delay. Petitioner claims clean antecedent.

Considering the aforesaid facts of the case, prayer for bail of the petitioner is allowed. In the event of arrest/surrender within six weeks from today, let the petitioner, mentioned above, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate I, Rosera, Samastipur in Rosera Police Station Case No. 113 of 2022, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
