The petitioner seeks bail in a case registered under Sections-302, 201 of the Indian Penal Code.
The prosecution case, in brief, is that a dead body was found lying in a well.
It has been submitted on behalf of the petitioner that the petitioner is in custody since 27-06-2018 and he has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. Charge sheet has already been submitted in this case. The petitioner is not named in the FIR. In course of investigation, father of the deceased has raised suspicion regarding involvement of the petitioner in this
Patna High Court Cr.Misc. No.51210 of 2018 (2) dt.18-09-2018 occurrence. Except for this, there is no other substantial evidence to suggest the implication of the petitioner in the present case nor there is any circumstantial evidence to suggest the involvement of the petitioner in the present case.
On behalf of the State, it is submitted that the name of the petitioner surfaced in this case in course of investigation. Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Rohtas at Sasaram in connection with Sasaram (Darigaon) P.S. Case No. 1732 of 2017.
