2. The petitioner is in custody in connection with Supaul P.S. Case No. 643 of 2025, for the offence punishable under sections 137(2), 140(3), 351(2) of the B.N.S. lodged on 27.12.2025 by the informant Randhir Chaudhary.
3. As per the prosecution story, the informant alleged that his daughter is missing since morning and fearing untoward incident, the FIR in which apprehension was made against one Kehsar. This led to the FIR.
4. Pursuant to the last order dated 13.05.2026, the Investigating Officer of the case namely A.S.I. Mukesh Kumar
2/4 of Supaul Police Station is present along with reply/case diary.
5. Learned counsel for the petitioner submitted that he owns and drives his car which is used as a taxi. On the insistence of the victim/other accused, he was only taking them to Ranchi when an accident took place near Nawada Toll Plaza and as the present case was already there, they were arrested.
6. The main allegation is against Kehsar who was declared juvenile and subsequently is out on bail. The petitioner has already suffered by being in custody since 28.12.2025. Further, if granted bail, he shall be diligently cooperating in the investigation and appear in trial.
7. Learned APP opposes the prayer submitting that his role has come in the statement of the victim girl.
8. Learned counsel for the petitioner submitted that the victim girl has been found to be major and she further refused to undergo medical examination.

Taking into account the submission of the parties aforesaid, as also that he has remained in custody for six months, has no criminal antecedents, Kehsar as recorded above has been granted relief after being declared juvenile, in that background, this Court is inclined to extend him the privilege of bail.

10. Let the petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of like amount each to the satisfaction of learned Chief Judicial Magistrate, Supaul, in connection with Supaul P.S. Case No. 643 of 2025 subject to the following conditions: (i) one of the bailor should be the family member/relative of the petitioner who shall provide official document (Aadhar Card/Voter Id/Driving License/Pan Card) to show his/her bona fide;
(ii) the petitioner shall appear on each and every date before the Trial Court and failure to do so for two consecutive dates without plausible reason will entail cancellation of his bail bond by the Trial Court itself;
(iii) the petitioner shall appear before the concerned police station every month for six months to mark his attendance and at the end of the period a certificate be submitted before the Trial Court;
(iv) the petitioner shall in no way try to induce or promise or threat the witnesses or tamper with the evidences, failing which the State shall be at liberty to take steps for cancellation of the bail bonds;
(v) the petitioner shall desist from committing any
4/4 criminal offence again, failing which the State shall be at liberty to take steps for cancellation of his bail bonds.
11. The personal appearance of Investigating Officer, ASI Mukesh Kumar stands dispensed with.
