Petitioners seek bail in a case registered for the offences punishable under Sections 302/34 of the Indian Penal Code.

Co-accused-Ankus Tiwari, the son of the petitioners, had taken, alongwith himself to, the brother of the informant to settle some dispute of accounting. Thereafter, dead body of the brother of the informant was noticed. Submission is that the case diary would reveal that there is no evidence of involvement of the petitioners in the occurrence aforesaid rather suspicion is there. Petitioners are in

Patna High Court CR. MISC. No.19963 of 2019(3) dt.04-06-2019 2/2 custody since 08.09.2018. Investigation of the case is already complete.

Considering the aforesaid facts, let the petitioners, above named, be released on bail on furnishing bail bonds of Rs.20,000/- (Twenty Thousand) each with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Sessions Trial No.657 of 2018 arising out of Andar Police Station Case No.176 of 2018, subject to the condition that both bailors shall be resident of territorial jurisdiction of the learned court below and further the petitioners shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioners.
