The petitioner, in the present case, is seeking regular bail in connection with Sugauli P.S. Case No. 33 of 2018 registered for offences alleged under Sections 304 (B),/34 of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner is father-in-law of the deceased and a learned Coordinate Bench of this Court has also granted privilege of anticipatory bail to the coaccused who happens to be brother-in-law of the deceased. It is submitted that the petitioner has no concern with the family of the deceased as he is living separately for last 10-11 years. Learned A.P.P. for the State is present and has opposed the

Patna High Court Cr.Misc. No.51857 of 2018 (2) dt.20-09-2018 prayer for bail, however, considering the facts and circumstances of the case, wherein the petitioner is the father-in-law and claims to be living separately with the family of the deceased as also that the elder brother-in-law has been granted the privilege of anticipatory bail by a learned Coordinate Bench of this Court, let the petitioner, above named, be enlarged on bail on his furnishing bail bond of Rs.15,000/- (Fifteen thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Motihari, East Champaran, in connection with Sugauli P.S. Case No. 33 of 2018 subject to the conditions U/S 437(3) Cr.P.C.
